These Terms of Service (“Terms”) govern the use of our website, products, and services, including purchases made through our online store (collectively, the “Services”).
By placing an order, you agree to these Terms. Certain provisions concerning website use also apply when you browse or otherwise use the website.
Nothing in these Terms excludes or limits any rights that cannot legally be excluded or limited under applicable consumer protection law.

You may use the website only for lawful purposes and in a manner that does not infringe the rights of others or interfere with the operation or security of the Services.

Eligibility to Purchase
To place an order, you must:

be at least 18 years old and legally capable of entering into a binding contract, or place the order with the direct involvement and authorization of a parent or legal guardian;

provide the information reasonably necessary for us to prepare, personalize, fulfil, and deliver the order.
By placing an order, you confirm that these conditions are met.
Products and Product Descriptions
We make reasonable efforts to ensure that product descriptions, images, dimensions, materials, personalization options, and prices are accurate and understandable.
Product photographs, digital previews, and images displayed on a screen are illustrative. Minor differences may occur due to:

differences between screens and display settings;
-
printing processes;
-
paper, ink, and material characteristics;
-
lighting and photography;
-
normal production tolerances;
-
the individual personalization details used for the order.
Minor differences that do not materially affect the agreed characteristics, quality, appearance, or conformity of the product do not necessarily constitute a defect or lack of conformity.
The final product must nevertheless conform to the order, the product description, the agreed specifications, and any digital proof approved by the customer.
Products may be modified, discontinued, or temporarily unavailable. Such changes will not affect orders that have already been accepted, unless the customer agrees otherwise or fulfilment becomes impossible.
Personalized and Made-to-Order Products
Carried In Light offers artwork created individually using information and personalization instructions provided by the customer.
Personalization details may include:

names;
-
dates;
-
locations;
-
custom text;
-
dedications;
-
occasion or event details;
-
astronomical or date-based information;
-
other instructions connected with the artwork.
After your order is placed, we will contact you by email to collect the information required to create the artwork.
You are responsible for ensuring that all information you provide is accurate, complete, and correctly spelled.
By submitting personalization details, you confirm that:
-
the information is accurate and complete;
-
you are entitled to provide and use the submitted names, dates, locations, text, images, dedications, and other content;
-
where information relates to another person, you are entitled to provide it for the purpose of creating the product;
-
the submitted content does not infringe intellectual property, privacy, personality, or other rights belonging to another person;
-
the content is not unlawful, threatening, abusive, discriminatory, defamatory, offensive, or otherwise inappropriate.
We may refuse, pause, or cancel an order if the personalization details are:
-
incomplete or unclear;
-
technically unsuitable;
-
impossible to use for the selected product;
-
unlawful or infringing;
-
offensive or abusive;
-
otherwise unsuitable for production.
If we cancel an order for one of these reasons after payment has been received, we will refund the amount paid, except where applicable law allows us to deduct reasonable costs already incurred as a direct result of unlawful or infringing content provided by the customer.
Personalization Process and Proof Approval
After receiving your order, we will contact you by email to collect the required personalization details.
We will prepare a digital proof and send it to you for review before printing.
You must carefully review the proof, including:
-
names;
-
dates;
-
locations;
-
spelling;
-
custom text;
-
occasion or event information;
-
layout;
-
design selections;
-
other personalization details.
Please notify us of any required corrections before approving the proof.
Production will normally begin after:
-
we have received all information necessary to prepare the artwork; and
-
you have approved the digital proof.
After approval or once production has begun, further changes may not be possible.
If the completed product accurately reproduces the information and proof approved by the customer, errors originating exclusively from information supplied or approved by the customer will generally not constitute an error on our part.
This does not affect statutory rights where the delivered product differs from:
-
the order;
-
the approved proof;
-
the product description;
-
the agreed specifications;
-
other binding information provided before purchase.
Estimated production and delivery periods may be extended if the customer does not provide the required information or does not respond to a proof approval request.
If we are unable to obtain the necessary information or approval after making reasonable attempts to contact the customer, we may pause or cancel the order. If the order is cancelled, we will refund the amount paid, subject to any deductions permitted by applicable law for work specifically requested and already completed.
Prices and Payments
Prices are displayed in the currency shown on the website.
Prices include VAT where applicable, unless clearly stated otherwise.
Shipping costs and any other mandatory charges payable to us will be displayed before the order is submitted.
Payments are processed through Shopify and the payment service providers available during checkout.
The available payment methods may depend on:

the customer’s location;
-
the selected currency;
-
the selected market;
-
the payment services currently available through Shopify.
We do not guarantee that every payment method will be available in every country.
An order may be refused or cancelled where there is a valid reason, including:

an obvious pricing or technical error;
-
failed payment authorization;
-
suspected fraud or unauthorized activity;
-
product unavailability;
-
incomplete or unsuitable personalization instructions;
-
inability to fulfil the order;
-
unlawful or infringing customer-submitted content.
If we cancel an order after receiving payment, we will refund the amount paid using the original payment method unless another method is agreed or required by law.
Order Placement and Acceptance
Submitting an order constitutes an offer to purchase the selected product.
An order is accepted when:

payment has been successfully authorized or received; and
-
an order confirmation has been sent by us or through the Shopify system.
An automated acknowledgment that an order was submitted does not prevent us from cancelling the order where there is a valid reason, such as:
-
an obvious pricing or product information error;
-
payment failure;
-
suspected fraud;
-
product unavailability;
-
inability to obtain the required personalization information;
-
inability to fulfil the order;
-
unlawful or unsuitable personalization content.
If an accepted order is cancelled by us, the customer will receive a refund of the amount paid, subject to applicable law.
Shipping and Delivery
Available shipping destinations, delivery methods, shipping costs, and estimated delivery periods are described in our Shipping Policy or displayed during checkout.
Unless expressly stated as guaranteed, production and delivery times are estimates.
Estimated delivery times may be affected by:

carrier disruptions;
-
customs procedures;
-
local postal delays;
-
public holidays;
-
incorrect or incomplete delivery information;
-
the customer’s failure to accept or collect the shipment;
-
circumstances genuinely outside our reasonable control.
We remain responsible for fulfilling the order and will provide reasonable assistance where a shipment handled by a delivery provider selected or offered by us is delayed, lost, or damaged.
For consumer orders, the risk of loss or damage passes to the customer when the goods are physically delivered to:
-
the customer; or
-
a third party designated by the customer, other than the carrier.
If the customer independently appoints a carrier that was not offered by us, risk may pass when the goods are handed over to that carrier, to the extent permitted by applicable law.
Nothing in this section limits mandatory consumer rights concerning:

delayed delivery;
-
failure to deliver;
-
lost shipments;
-
damaged shipments;
-
cancellation or termination;
-
refunds or other legal remedies.
Right of Withdrawal and Personalized Products
The products currently offered by Carried In Light are created to the customer’s specifications or are clearly personalized.
For this reason, the statutory 14-day right of withdrawal available to EU consumers for many distance contracts does not apply to these personalized products.
This means that a personalized product cannot be returned or cancelled merely because the customer:
-
has changed their mind;
-
no longer wants the product;
-
selected the wrong size;
-
prefers a different design after approving the proof;
-
no longer needs the gift.
This exclusion does not depend on whether physical production has already begun.
It does not affect statutory rights where the product is:
-
damaged;
-
defective;
-
incorrect;
-
materially different from the approved proof;
-
otherwise not in conformity with the contract.
As a voluntary customer service measure, you may contact us before production begins and ask whether cancellation is still possible.
We will review the request, but cancellation cannot be guaranteed.

Electronic Cancellation or Withdrawal Requests
Where an electronic cancellation or withdrawal request function is available on the store, it may be used to submit a request concerning an order.
The customer may be asked to provide or confirm information such as:

name;
-
email address;
-
order number or reference;
-
the product concerned;
-
confirmation of the request.
An automatic email acknowledgment confirms only that the request has been received.
It does not by itself confirm:
-
that the order is eligible for cancellation;
-
that a statutory right of withdrawal applies;
-
that a refund has been approved.
The availability of an electronic request function does not create a right of withdrawal for goods made to the customer’s specifications or clearly personalized.
We will review each request in accordance with:

these Terms;
-
our Refund, Return & Withdrawal Policy;
-
the status of the order;
-
applicable consumer law.

Damaged, Defective, Incorrect, or Non-Conforming Products
If a product arrives damaged, defective, incorrect, or otherwise not in conformity with the contract, please contact us as soon as reasonably possible.
To help us investigate the issue, we may ask you to provide:

the order number;
-
a description of the problem;
-
photographs showing the damage, defect, or error;
-
photographs of the packaging where relevant;
-
other information reasonably necessary to assess the complaint.
Providing photographs may help us resolve the matter more quickly, but it does not limit statutory consumer rights where obtaining photographs is impossible or unreasonable.
We will provide the remedy required under applicable law.
Depending on the applicable law and circumstances, the available remedy may include:

correction or repair;
-
replacement;
-
price reduction;
-
termination of the contract and a refund.
Where the product is not in conformity with the contract, we will bear the necessary costs of the remedy where required by law.

Statutory Conformity Rights
Nothing in these Terms excludes or limits statutory rights relating to goods that are defective or not in conformity with the contract.
Consumers in the European Union are entitled to the remedies provided by applicable consumer law.
Depending on the circumstances, these remedies may include:

replacement;
-
price reduction;
-
termination of the contract and a refund.
The seller is not responsible for problems caused exclusively by:

damage occurring after delivery that is unrelated to an existing lack of conformity;

improper handling or storage;

misuse;

failure to follow reasonable care instructions.
This limitation does not apply where the problem results from a defect, lack of conformity, inadequate instructions, unsuitable packaging, or another matter for which the seller remains responsible under applicable law.
Intellectual Property

artwork presentations;

layouts;
-
logos;
-
branding;
-
product descriptions;
-
design systems;
-
templates;
-
software;
-
other materials;
is owned by Carried In Light, licensed to us, or used with appropriate permission.
This content is protected by copyright, trademark, and other applicable intellectual property laws.
You may not copy, reproduce, modify, republish, distribute, sell, license, or commercially exploit website content without prior written permission, except where such use is permitted by law.
Purchasing a product does not transfer intellectual property rights in:

the Carried In Light brand;
-
the website;
-
design templates;
-
artwork systems;
-
production methods;
-
product concepts;
-
software;
-
other protected materials.
The customer may use the physical product purchased for personal purposes, including displaying it or giving it as a gift.
Customer-Submitted Content
If you provide names, dates, locations, custom text, dedications, photographs, files, or other content for personalization, you grant us a limited, non-exclusive right to use that content only as reasonably necessary to:

process and fulfil the order;
-
create the personalized artwork;
-
prepare and send the proof;
-
produce and deliver the product;
-
provide customer support;
-
handle corrections, complaints, replacements, or refunds;
-
comply with legal obligations;
-
establish or defend legal claims.
You retain any rights that you hold in the submitted content.
We will not use identifiable personalization details or order-specific artwork in public advertisements, social media, portfolio materials, examples, or promotional content unless:

you have given separate permission; or
-
the content has been appropriately anonymized.
Privacy and Personal Data
Personal information is processed in accordance with our Privacy Policy.
The Privacy Policy explains:

why we use it;

the legal bases for processing;

the rights available under applicable data protection law.
The Privacy Policy forms part of the information governing the use of our Services.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
For consumers, our liability is governed by applicable mandatory consumer protection law.
Nothing in these Terms limits rights or remedies concerning:

delivery of the product;

conformity of the product with the contract;
-
damaged, defective, or incorrect products;
-
statutory refunds, repairs, replacements, or price reductions;
-
fraud or intentional misconduct;
-
death or personal injury where liability cannot legally be limited;
-
any other liability that cannot legally be excluded.
To the extent permitted by applicable law, we are not responsible for loss or damage caused exclusively by:

incorrect or incomplete information supplied or approved by the customer;
-
unlawful or infringing customer-submitted content;
-
misuse or unauthorized modification of the product after delivery;
-
events genuinely outside our reasonable control.
Events Outside Our Reasonable Control
We may not be responsible for a failure or delay to the extent that it is directly caused by an event genuinely outside our reasonable control.
Such events may include:

natural disasters;
-
war or civil unrest;
-
government restrictions;
-
widespread transport or postal disruption;
-
strikes not limited to our own personnel;
-
major power, telecommunications, or internet failures;
-
serious disruption of essential third-party infrastructure.
Where such an event affects an order, we will take reasonable steps to:

reduce the effects of the disruption;
-
inform the affected customer where appropriate;
-
resume performance as soon as reasonably possible.
If performance becomes impossible or is materially delayed, the customer retains any cancellation, termination, refund, or other rights available under applicable law.
Changes to These Terms
We may update these Terms to reflect:

changes to the Services;
-
legal or regulatory requirements;
-
technical changes;
-
changes to service providers.
Updated Terms will apply to future use of the website and future orders from the date they are published.
The Terms applicable to an order are generally the Terms in effect when the order is placed.
We will not retroactively change the material terms of an accepted order unless:

the change is required by law;
-
the change is necessary to correct an obvious error and does not unfairly disadvantage the customer;
-
the customer expressly agrees to the change.
The “Last updated” date will be revised whenever these Terms are updated.
Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
The invalid provision will be interpreted or replaced, where legally possible, in a manner that most closely reflects its lawful purpose without reducing mandatory consumer rights.
Governing Law and Jurisdiction
These Terms are governed by the laws of Poland and applicable European Union law.
If you are a consumer, this choice of law does not deprive you of mandatory consumer protection granted by the law of the country in which you habitually reside.
Any dispute may be brought before a court having jurisdiction under applicable Polish, national, or European Union law.
Nothing in these Terms requires a consumer to bring proceedings exclusively before the courts of Poland.
